1. What It Is and Why It Matters
A permit to work (PTW) is a formal written safe system of work designed to control high-risk activities on construction sites. It is not a risk assessment and not a method statement — it is a documented control mechanism that ensures specific preconditions have been met before high-risk work begins, that those conditions are maintained throughout the work, and that the workplace is returned to a safe state when the work is complete.
The legal basis for permit-to-work systems derives from the Management of Health and Safety at Work Regulations 1999 (MHSWR), particularly Regulation 3 (risk assessment) and Regulation 4 (principles of prevention), and the Health and Safety at Work etc. Act 1974 (HSWA), Section 2 (general duty to ensure safe systems of work). HSG250 provides detailed HSE guidance on permit-to-work systems and is the recognised standard of good practice. While no single regulation mandates a permit to work by name, the PTW system is the expected method of controlling high-risk work where the consequences of failure are severe.
Every permit must be task-specific, location-specific, and time-limited. It must be authorised by a competent person who is independent of the work — self-issue is never acceptable. The competent person must verify that all preconditions are physically in place at the point of work before the permit is issued. A permit signed in the site office without a visit to the work location provides no safety value whatsoever.
Workers have the right to refuse to carry out work without a valid permit. If a task requires a permit and one has not been issued, no worker should feel pressured to proceed. This right is supported by Section 44 of the Employment Rights Act 1996, which protects workers from detriment for raising health and safety concerns.
A PTW does not replace a risk assessment or method statement
A common misconception is that a permit to work covers all the documentation for a particular task. It does not. The risk assessment identifies the hazards and evaluates the risks. The method statement sets out how the work will be done and what controls will be applied. The permit to work confirms that all those preconditions have been met at a specific time and place, and formally authorises the work to proceed. All three documents are required — one does not substitute for another.

If conditions change, work stops
A permit is only valid while its stated conditions remain in place. If an unexpected service is discovered during excavation, if weather conditions deteriorate, if another trade needs to work in the same area, or if any other condition changes — the permit must be suspended immediately. Work must stop and the area made safe. The permit can only be revalidated after the issuer has revisited the work area, confirmed that all preconditions are restored, and signed the permit back into force.
3. Common Mistakes
Starting work without a permit
The most dangerous mistake is beginning high-risk work before a valid permit has been issued. Pressure to meet programme deadlines is no justification for starting without formal authorisation. If an activity requires a permit and one has not been issued, the work is unauthorised and must not proceed. Workers who are asked to start without a permit should refuse and report the situation to their supervisor or the site safety team.
Not stopping when conditions change
A permit is only valid while the stated conditions remain in place. If an unexpected hazard is discovered, if weather conditions deteriorate, if another trade enters the work area, or if any precondition is no longer met, work must stop immediately. Continuing to work under a permit whose preconditions have changed is effectively unpermitted work. The permit must be suspended and the issuer notified before any further work takes place.
Not reading the permit
Every person working under a permit must read and understand its contents — including the scope of work, the location, the time limit, the specific preconditions, and the emergency arrangements. A permit that is signed without being read provides no protection. Workers should ask questions if anything on the permit is unclear and should never sign a permit they have not fully understood.
Permits left open beyond their validity period
Every permit must have a defined expiry time. A permit issued at 08:00 for a single shift is not valid the following morning. Work that continues beyond the stated validity period is unpermitted work. If the task is not complete by the expiry time, the permit must be closed and a new one issued after re-verification of all preconditions. Open-ended permits that are never formally closed create a dangerous ambiguity about whether controls are still in place.
Multiple workers sharing a permit without signing
Every person working under a permit must sign on to acknowledge they have read and understood the permit conditions. A single signature on behalf of a group is not acceptable. Each individual worker must confirm their understanding by signing the permit. This ensures that every person on the job is aware of the hazards, the controls, the boundaries of the permitted work, and the emergency arrangements.

Can a worker refuse to work without a permit?▾
Yes. If a task requires a permit to work and one has not been issued, a worker has the right to refuse to carry out that work. Section 44 of the Employment Rights Act 1996 protects employees from detriment for leaving or refusing to return to a place of work in circumstances of serious and imminent danger. A worker who reasonably believes that starting high-risk work without a valid permit places them in danger is protected by law. No worker should be pressured, disciplined, or dismissed for refusing to carry out unpermitted high-risk work.
What is the difference between a PTW and RAMS?▾
A risk assessment and method statement (RAMS) identifies the hazards of a task, evaluates the risks, and sets out the controls and safe method of work. It is produced before the work begins and describes how the work should be done. A permit to work (PTW) is a separate, additional document that confirms — at a specific time and location — that all the preconditions set out in the RAMS are physically in place and that work is formally authorised to proceed. The RAMS tells you what needs to be in place; the permit confirms that it is in place. Both documents are required for high-risk activities — one does not replace the other.
How long is a permit to work valid?▾
A permit to work is time-limited and should typically cover a single shift or a defined working period. Every permit must state a clear expiry time. At the end of the shift or the stated validity period, the permit must be closed and the area made safe. If the work continues the next day or the next shift, a new permit must be issued after all preconditions are re-verified at the point of work. An open-ended permit that runs indefinitely provides no ongoing assurance that conditions remain safe and is not compliant with HSG250 guidance.
